2. When these terms apply

2.1 These terms apply to all our services: group classes, open training, courses (including teen courses), workshops, private lessons, events, parties, and studio rental.

2.2 By booking through Eversports or our website, or by taking part in any activity at our studio, you accept these terms. We show these terms before you pay, and you can download them.

2.3 Each product has its own conditions, shown in Eversports when you buy it. These include price, duration, minimum term, renewal, notice period, pause options, credit validity, and booking and cancellation windows. Those conditions are part of your agreement with us. On those points, the conditions in Eversports apply.

2.4 Nothing in these terms limits the rights you have under Dutch consumer law.

3. Bookings, credits, and payments

3.1 All bookings and payments go through Eversports. You need an Eversports account in your own name.

3.2 Memberships, class cards, and credits are personal. You may not share, sell, or transfer them to someone else.

3.3 Membership credits roll over from month to month while your membership is active. When your membership ends, any unused credits expire. They are not paid out or refunded.

3.4 Credits from a trial, drop-in, or class card are valid for the period shown in Eversports at purchase. After that period they expire.

3.5 Membership credits can be used for regular group classes and open training. They cannot be used for private lessons, courses, workshops, events, or parties, unless we say otherwise.

3.6 Courses (such as teen courses) are paid in full upfront for the whole course. Missed course sessions are not refunded or credited.

3.7 Memberships are paid monthly by direct debit. If a payment fails or is reversed, we may block new bookings until it is paid. If it stays unpaid, we send you a reminder that gives you 14 days to pay, counted from the day after you receive it. If you still do not pay, we may charge collection costs as allowed by Dutch law.

3.8 Payments are not refundable, including for classes you missed or did not use. This does not apply when we cancel a class (see 4.1), when you use your right to change your mind (see 3.9), or when Dutch law gives you a right to a refund.

3.9 If you buy a membership or class card online, you have 14 days to change your mind and cancel it without giving a reason. Email us within 14 days of your purchase. If you asked to start within those 14 days, you pay for the part you already used. This right does not apply to bookings for a class, course, workshop, event, or party on a fixed date.

4. Classes, schedule, and the studio

4.1 We may change the schedule, the teacher, or the level of a class, or cancel a class. For example, because of low sign-ups, teacher illness, a problem in the studio, or circumstances outside our control. We let you know as soon as we can. If we cancel a class you booked, your credit is returned. If we cancel a course session, we offer a replacement session. If that is not possible, we refund that session.

4.2 Open training slots may be cancelled to make room for other activities in the studio. If you booked one, your credit is returned.

4.3 The studio may close on public holidays and during breaks we announce in advance. Because membership credits roll over, these closures do not change the monthly fee. If we have to close the studio for more than 14 days in a row for any other reason, we pause your monthly fee or extend your membership by the same time.

4.4 A teacher may ask you to join a different level if that is safer for you or the group.

5. Acceptance of risk

5.1 Aerial arts, such as aerial silks, hoop, and sling, are physical activities. They involve working at height, hanging upside down, holding your own body weight, dropping, spinning, and the chance of falling.

5.2 Even with trained teachers, crash mats, and well-maintained equipment, these activities always carry a risk of injury. This includes bruises, friction burns, muscle strains, sprains, dislocations, fractures, and head, neck, or back injuries. In rare cases, injuries can be serious or permanent.

5.3 You take part voluntarily and at your own risk. By booking or taking part, you confirm that you understand these inherent risks and that you accept them.

5.4 This applies to every activity at our studio: group classes, open training, courses, workshops, private lessons, events, parties, and studio rental.

5.5 Open training is for students aged 18 or older who already take our regular classes. There is no teacher. Never train alone: at least two people must be in the studio. Only practise moves you have already learned in class and can do safely, always above a crash mat. You are fully responsible for your own training.

6. Your health and fitness to take part

6.1 By booking, you declare that you are in good health and physically able to take part, and that no medical reason stops you from doing so. If you are not sure, check with your doctor before you start.

6.2 Before every class, tell your teacher about anything that could affect your safety. For example: an injury, recent surgery, pregnancy, a heart or blood pressure condition, epilepsy, dizziness, joint or back problems, or medication. Tell us again if anything changes.

6.3 If you are pregnant, only take part after checking with your doctor or midwife. Your teacher may adapt or limit what you do.

6.4 Do not take part under the influence of alcohol or drugs.

7. Safety rules

7.1 Always follow your teacher's instructions and the safety guidelines we share in class or on our website.

7.2 Work within your own limits. Do not try moves you have not been taught. Stop straight away if you feel pain, dizziness, or discomfort, and tell your teacher.

7.3 Do not climb, use, or adjust any equipment or rigging without permission from a teacher. Only our teachers, or other people with rigging knowledge that we appoint, install, change, or remove rigging.

7.4 A teacher may refuse or stop your participation if they think it is unsafe for you or others. If this happens because you did not follow sections 6 or 7, your credit is not returned.

7.5 Some classes have an assistant. Assistants are experienced students who help the teacher. They do not replace the teacher. The teacher leads the class and is responsible for it.

7.6 If there is an accident, our teacher gives first aid and may call 112. You agree that we may do this.

7.7 If you get injured, tell your teacher straight away, and email us within 7 days so we can learn from it.

8. Children and teens

8.1 Our adult classes are for people aged 16 and older.

8.2 Younger participants can join teen courses, kids parties, and other activities we offer for their age group.

8.3 When you book for a participant under 16, you confirm that you are the child's parent or legal guardian, or that a parent or guardian agrees to the booking and to these terms. You accept these terms on the child's behalf, including sections 5, 6, and 7, and you confirm that the child is fit to take part. A parent or guardian must be reachable by phone during the activity.

8.4 Participants aged 16 or 17 need permission from a parent or guardian to take part, and to buy a membership. We may ask for this permission in writing.

8.5 Parents and guardians are responsible for their child before and after the activity. Please drop off and pick up on time. During parties, the adults present stay responsible for children who are not on the equipment.

9. Our liability

9.1 We do our best to make every activity safe. Our teachers are trained, and our equipment and rigging are maintained and checked regularly.

9.2 We are liable for injury or damage caused by our fault. For example, faulty equipment or rigging, or teaching that falls below what you can reasonably expect from a professional studio.

9.3 We are not liable for injuries that come from the inherent risks of aerial activities described in section 5, when we have taken the care that can reasonably be expected of us. An injury can happen even when everyone does everything right.

9.4 For damage that is not personal injury, such as damage to your belongings or other financial loss, our liability is limited to the price you paid for the class, course, or service in which the damage happened. In that case we are also not liable for indirect damage, such as loss of income. These limits do not apply in case of intent or gross negligence on our side.

9.5 We are not liable for loss, theft, or damage of personal belongings brought to the studio, unless it is caused by our fault. Please leave valuables at home.

9.6 You are liable for damage you cause to the studio, the equipment, the building, or other people, for example through careless use or by not following instructions. We recommend that you have personal liability insurance (aansprakelijkheidsverzekering).

9.7 Nothing in these terms limits our liability where Dutch law does not allow it.

10. Photos and video

10.1 We sometimes take photos and videos during classes, courses, events, and parties, and share them on our website and social media.

10.2 If you do not want to appear, tell your teacher before the activity or email us. We will leave you out, and we will remove or blur anything already posted if you ask.

10.3 We only share recognisable photos or videos of children under 16 with written permission from a parent or guardian.

10.4 You may film yourself for your own practice. Ask others before they appear in your photos or videos. Do not use our teachers' choreography or teaching material commercially without their permission.

11. Behaviour

11.1 Treat teachers, other students, and the studio with respect. Unwanted physical contact, harassment, or discrimination is not accepted.

11.2 If someone seriously or repeatedly breaks these terms, we may refuse entry or end their membership, without a refund.

12. Private lessons, events, parties, and studio rental

12.1 Private lessons, events, and parties are paid in advance. The price, duration, group size, and cancellation conditions are in your booking confirmation or quote.

12.2 The person who books a private lesson, event, or party is responsible for the group. They make sure every participant knows and accepts these terms, including sections 5, 6, and 7. When the group includes children, the person who books confirms that a parent or guardian of each child agrees to these terms and that each child is fit to take part. We may ask every participant, or for children a parent or guardian, to fill in a short risk and fitness form before the event. We may refuse participation to anyone who has not filled it in.

12.3 When you rent the studio, you use it at your own risk. You supervise your own participants and make sure they know and accept the risks. You must have your own liability insurance. You only use the equipment we agreed on, you check it before use and stop if you see any damage, and you do not change any rigging. Participants under 16 are only allowed under your direct supervision. You cover claims from your participants against us that result from your activities, unless the damage is caused by our fault. You leave the studio clean and tidy.

12.4 Any damage or extra cleaning after an event, party, or rental is charged to the person who booked it.

13. Privacy

13.1 We use your personal data only to run our services: to manage your bookings, payments, and membership, to keep you safe in class, and to send you studio news. We follow the GDPR (AVG).

13.2 Eversports processes your booking and payment data on our behalf.

13.3 If you share health information with us, you agree that we use it only to keep you safe in class. We only share it with your teacher, and we delete it when you ask us to.

13.4 We never sell your data. You can unsubscribe from our newsletters at any time.

13.5 To see, correct, or delete your data, email fly@aerials.amsterdam. More details are in our Privacy Policy.

14. Changes, complaints, and applicable law

14.1 We may update these terms from time to time. When we do, we let you know by email or on our website at least 30 days before the changes start, and the latest version is always on our website. If a change puts you in a worse position, for example stricter rules on credits or cancellations, you can end your membership before the change applies to you.

14.2 If you have a complaint, email fly@aerials.amsterdam with a clear description. We reply within 14 days.

14.3 If any part of these terms is not valid, the rest still applies.

14.4 Dutch law applies. Disputes go to the competent Dutch court.
